Terms of service

Effective

Patrick Clinger operates My Board Games from Orange County, California, providing free board-game information and a game finder at myboard.games. In these terms, “we,” “us” and “our” mean Patrick Clinger, operating as My Board Games.

Please read these terms before using the site. They set out the conditions on which we offer access to our content and tools. If you do not agree to these terms, do not use the site.

These terms include warranty disclaimers and a US $50 total limit on liability, subject to the exceptions below.

Using the site

Use the site lawfully. Do not interfere with its operation, introduce malicious code, bypass security or access controls, make automated requests that disrupt or overload the site, or use it to infringe others’ rights. We may restrict access to protect the site or address misuse.

Our original text, illustrations and code are protected by applicable intellectual property law. You may read, link to and share links to our pages. Other reuse requires permission unless the law or an applicable license allows it. Game names, trademarks, rulebooks and linked videos belong to their respective owners; their inclusion does not imply endorsement.

Information and outside services

Our recommendations are editorial opinions, not guarantees that a game will suit you or produce a particular result. Our explanations and finder results may contain errors or omissions. Rules, editions, prices and availability can change; check the publisher’s current information and the seller’s terms before making a purchase. Follow the manufacturer’s age guidance and safety instructions; our recommendations do not replace them.

We do not sell games, process purchases or act as an agent for publishers or sellers. We do not control or warrant external websites, products, downloads or videos. Their providers are responsible for their own offerings, and purchases or other dealings with them are between you and the provider. External services have their own terms and privacy practices.

Warranty disclaimer and availability

To the fullest extent permitted by applicable law, we provide the site, content and tools “as is” and “as available,” without express or implied warranties, including warranties of merchantability, fitness for a particular purpose and noninfringement. We do not warrant accuracy, completeness, uninterrupted availability, security or freedom from harmful code. No information or communication from us creates a warranty not expressly stated in these terms.

We may change, suspend or discontinue any part of the site. We do not promise ongoing access, maintenance or updates. You are responsible for deciding whether the information meets your needs and for protecting your devices.

Limitation of liability: US $50 total

Subject to the exceptions below and to the fullest extent permitted by applicable law, Patrick Clinger’s total aggregate liability to you arising out of or relating to the site, its content or tools, or these terms will not exceed US $50. This is one total limit for all claims combined, not a separate limit for each claim, incident or visit.

Subject to the same exceptions, we will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, business opportunities, goodwill or data arising out of or relating to the site, its content or tools, or these terms.

These limits apply regardless of the legal basis of a claim, including contract, tort (including ordinary negligence), statute or otherwise, even if we have been advised that a loss is possible. The site is offered free of charge in reliance on these limitations and disclaimers.

Rights and liabilities we do not exclude

Nothing in these terms excludes or limits liability for our fraud, willful misconduct or gross negligence, or any liability that applicable law does not permit us to exclude or limit. Nothing waives mandatory consumer protections or other rights or remedies that cannot lawfully be waived, including any nonwaivable right to seek public injunctive relief. If the law applicable to you does not allow a particular disclaimer or limitation, that provision applies only to the extent the law permits.

Governing law and disputes

California law governs these terms, except where applicable law requires otherwise. Mandatory protections under the law where you live remain available to you.

To the extent permitted by applicable law, disputes arising out of or relating to these terms or the site must be brought in the state courts located in Orange County, California, or the United States District Court for the Central District of California, and you and we consent to their jurisdiction. This does not prevent either party from bringing an eligible claim in a small claims court with jurisdiction, or prevent you from using another court where applicable law gives you that right.

You may contact us about a dispute, but doing so is not a prerequisite to bringing a claim and does not extend any legal deadline.

How these terms work

If a provision is held unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision on one occasion does not waive the right to enforce it later. Provisions about intellectual property, warranty disclaimers, liability and disputes continue to apply to earlier use after you stop using the site.

Changes and contact

We may update these terms by posting a revised version here with a new effective date. Revisions apply prospectively, subject to any notice or agreement required by applicable law; they do not change the terms applicable to a dispute that arose before the revision. Privacy practices are described in our Privacy Policy.
